1) These terms apply to your use of the CreatingLivingMemories.com website (“Site”).  By using this Site you accept these terms and agree to be bound by them.  The owner and operator of the Site is the Trustees of the Necropolis Springvale (“Springvale Botanical Cemetery”).

2) We may change these terms at any time.  If we do, we will display a notice on the homepage of this website for one month after the change is made.  Your use of the Site after such a notice appears will constitute acceptance of the amended terms. 

3) If you do not agree to these terms, then you may not use this Site.

Use of the Site

You agree that your use of this Site is subject to all applicable local, state, national and international laws and regulations.  Without limitation, you agree:

• not to use the Site for illegal activities;
• not to use the Site to attempt to gain unauthorised access to other computer systems;
• not to interfere with the use and enjoyment of other people using the Site;

You agree that you will not submit or upload to the Site any material that:

• is defamatory, threatening, inflammatory, false, misleading, deceptive, fraudulent, or tends to mislead or reflect unfairly on any other person, business or entity;
• unjustly interferes with any third party’s use and enjoyment of the Site;
• contains content that is protected by copyright (which may include articles, illustrations, images, or other content);
• infringes upon any copyright, trademark, or patent rights;
• contains viruses, harmful or destructive content;
• does not comply with these terms.

Review & Removal of Material

• Springvale Botanical Cemetery reserves the right (but disclaims any duty, obligation or responsibility) to review, screen, refuse to post, remove in entirety, or edit (at any time and without prior notice) any material that is submitted or uploaded to the Site that it believes, in its absolute and sole discretion violates these terms.

Termination

Springvale Botanical Cemetery reserves the right, in its sole and absolute discretion, to modify, suspend or discontinue at any time, with or without notice, this Site or any part of this Site, including but not limited to the Site’s features.  If this occurs, you may not be able to retrieve or gain access to any material that you have submitted or uploaded to the Site.

Indemnity

You agree to indemnify and hold Springvale Botanical Cemetery, its agents, officers, directors and employees harmless from any claim, demand, or damage (whether direct, indirect or consequential) made by anyone in connection with your use of this Site, with content you submit on this Site, with any alleged infringement of intellectual property and any other acts or omissions in relation to this Site.

The information, content, products, services and materials contained on this Site are provided “as is” and “as available” without warranties of any kind, either express or implied.

a) In no event will Springvale Botanical Cemetery be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any loss or damages whatsoever in any manner arising out of or in connection with the use, inability to use, performance of, or services provided on this Site.  Springvale Botanical Cemetery assumes no responsibility and will not be liable for any damages to, or viruses that may infect your computer equipment or other property.  Springvale Botanical Cemetery assumes no responsibility or liability in any manner arising out of or in connection with any information, content, products, services or material available on or through this Site.

b) You and Springvale Botanical Cemetery agree that the warranty disclaimers and limitations of liability in these terms are fair and reasonable.

c) If you are dissatisfied with the Site or do not agree to any provisions of these terms, your only remedy is to stop using the Site.
